Cartie Waiver Release Form

In consideration of being permitted to utilise the Royal Deeside Cartie race track facilities, and in consideration of the benefits received by me/us as a result of said use, I, together with my/our heirs, executors, administrators, and assigns, hereby release, waive, and forever discharge and covenant not to sue the Event Organisers, Venue Owner its sponsors, and all of their officers, agents, members, employees, full or part-time, insurers, lessees, lessors, and associates of any status whatsoever, all for the purpose herein referred to as Releasees, from all liability to me/us, my/our heirs, executors, administrators, and assigns for all loss or damage, and any claim or damage therefore, on account of injury to my person or property or resulting in my death, whether caused by the negligence of Releasees or otherwise while I am utilising the above described race track facilities and/or observing any Cartie Race and/or related event being held at Kincardine Castle and Estate.

I/we hereby further agree to indemnify and to hold forever harmless the said Releasees from any and all claims, loss, liability, damage, or cost Releasees may incur due to my presence at Kincardine Castle and Estate while utilising the above-described race track facilities, and/or participating in and/or observing said Cartie Races and/or events.

I/we hereby assume all responsibility for and risk of bodily injury, death, or property damage due to any act or omission of Releasees while so utilising the above described race track facilities and/or participating in and/or observing said Cartie Races and/or events.

I/we expressly agree that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws within Scotland and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and legal effect.

I/we, being of lawful age and/or having been granted permission to participate, in consideration of being permitted to utilise the above described racetrack facilities and/or participate in and/or observe Cartie Races and/or events at Kincardine Castle and Estate release and forever discharge Releasees, their heirs, administrators, and executors of and from any and every claim, demand, action, of whatsoever kind or nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death, and/or property damage which may occur as a result of my utilisation of the above described race track facilities and/or any participation in and/or observation of Cartie Races and/or events or any activity in connection therewith, whether by negligence or not.

I/we also consent to be photographed or filmed by Etiom Limited, and/or the press (television, magazines, newspapers). I understand that such photographs or films may be used and reproduced by Etiom Limited, and/or the media by all means and in all media in perpetuity for the purposes of advertising, publicity and highlighting the event.
